We created this Privacy Statement in order to demonstrate our firm commitment to protecting the privacy of Contributors (including Contributors, purchasers, advertisers, and Executive or Associate Producers) to this film and users of our Web Site (the Site). The following discloses how we gather and use information on the Site and in connection with Contributions (including Contributions, purchases, advertising, and becoming Executive or Associate Producers). We use the information we collect about you to publish lists of Contributors, advertisers, executive producers and associate producers. By using the Site, making financial Contributions to the film, purchasing merchandise or advertising on the Site or in the Film, you consent to our collection, use and disclosure of your information, as described below. 1. What information do we collect? In order to run the Site and promote the Film, we collect two types of information from Contributors and visitors: personally identifiable information and aggregated information. Our primary goal in collecting information from you is to provide a publicized list of online or on-screen credits for Contributors, advertisers, executive producers, and associate producers.

 

Personal Information We collect personal identifying information (including, but not limited to, name, address, phone number and e-mail address), demographic information (including, but not limited to, age, household size, income level, education level and gender), and financial information (including, but not limited to, credit card or bank account, credit union account, or other financial account information) when you make a financial Contribution, purchase merchandise or advertising, or become an executive producer or associate producer. We may also collect and post for public viewing such personal identifying information and comments as you care to share on our Guest book.

 

Non-Personal and Aggregated Information This refers to information that is not personally identifiable. The Host of the Site may automatically gather certain information about you based upon your activity on the Site and the pages you visit and may also collect machine data such as processor type, processor speed, operating system type, browser type, audio devices, modem devices, video cards and any software on your computer that may interact or interfere with the Site. This information may include the web site’s Uniform Resource Locator (“URL”) that you just came from, which URL you next go to, what browser you are using, and your Internet Protocol (“IP”) address. This information is compiled and analyzed on an aggregated basis. For instance, our Host or we may know that ten thousand people visit this Privacy Policy during a particular time period, but would not know their names or addresses from this information alone, so they are anonymous to us. We may also use this information to do internal research on our visitors’ demographics.

 

2. Where do we collect information from you?

 

We collect personal identifying information on the Site. We collect this, and other information, as part of the Contribution, investment, and advertising pages. We also collect information from visitors to our Site regarding the referring Uniform Resource Locator (“URL”), your Internet Protocol (“IP”) address, which browser you used to come to the Site and the pages of our Site that you viewed during your visit. An URL is the global address of documents and other resources on the World Wide Web. An IP address is an identifier for a computer or device on a TCP/IP network. TCP/IP stands for “Transmission Control Protocol/Internet Protocol,” and is the suite of communications protocols used to connect hosts on the Internet. Networks using the TCP/IP protocol route messages based on the IP address of the destination.

 

Contributors’ information. While registering as a Contributor, purchaser, advertiser, or producer, we ask visitors to provide personal identifying and demographic information. The information you provide during registration is placed in your profile. You may email or write to us to change your profile information at any time and should notify us if you have moved before receiving any merchandise or “thank you” gifts. In addition, you may provide other personal identifying information and financial information, such as a credit card number and other credit card verification information in the course of making a contribution or purchase. We may update the information in your Profile with information obtained through generally accepted methods of address verification.

 

Non-personally identifiable information. While you are using the Site, we collect non-personally identifiable information including, without limitation, information regarding the pages on the Site that you visit, your interactions with those pages, and any software on your computer that may interact or interfere with our Site. The Host of the Site may implement its own unique technology that may include building a database of the types of sites from which you came to the Site and any site you may have visited as a result of clicking on a link from the Site. This information is ultimately stored in the form of categories and, in some cases, specific URLs. Your IP address may be used to help diagnose problems that may arise with the Site, its servers and software, and to administer the Site.

 

Guest Book. When you visit our online Guest Book and make any type of comment or provide any type of identifying information, it will be posted online for public viewing. You should not post in the Guest Book any identifying information or comments that you do not wish to be viewed by the public. We reserve the right to remove any inappropriate, offensive, or obscene material posted in the Guest Book.

 

Contact Information and Third Party Data. If you contact us by e-mail or letter, we may keep a record of your personal correspondence. Thus, if you ask a question regarding the Site or the Film, we may collect such information in a file specific to you or in a general file that is indexed in another manner. Moreover, if you contact us through our feedback area, we require your name and e-mail address in order to send you a reply. Additionally, if other Contributors, purchasers, advertisers, producers, visitors or third parties send us correspondence about your activities or postings on our Site, we may keep the information in a file specific to you or in a general file that is indexed in another manner.

 

3. How is your information used?

 

We use the information we collect to list those who have contributed to the financing of the Film, to send out merchandise and thank you gifts, and to give notice of events related to the Film. In particular, we use the information you provide as described below.

 

The Site. We collect personal identifying information and other information on the Site in order to keep track of Contributors, advertisers, executive and associate producers, and purchasers for purposes of publicly identifying and thanking those who help make the Film possible, providing thank you gifts and merchandise where applicable, and to give notice of events that are related to the Film (such as commencement of filming, completion of filming, theatrical release, DVD release, and parties). On the Site, if you submit comments or request information from us, then we will collect information from you in order to respond to your communications or requests. We also collect information regarding the referring URL, your IP address, which browser you used to come to the Site and the pages of our Site that you viewed during your visit. We use this information to better understand the habits and methods our visitors and Contributors use to reach our Site and how we may better serve their needs, to help diagnose problems that may arise with the Site, and to administer the Site.

 

Contributors, purchasers, advertisers, and producers. We use personal identifying information to confirm or clarify submitted information, Contributions, purchases, advertising agreements, and other financing and to provide our Contributors, purchasers, advertisers, and Executive or Associate Producers with merchandise, thank you gifts, updated information, and announcements about the Film’s progress and related events. Demographic information is used to tailor our financing and marketing campaigns to reach the largest possible audience. We will only disclose names and business contact information to the public as movie credits on the Site or in the Film’s closing credits, and will not disclose any other personal identifying information about any contributor, purchaser, advertiser, or Executive or Associate Producer to a third party unless they consent to the disclosure, or except as may be required by law, governmental authority or to cooperate with law enforcement authorities. We may, on occasion, share such information in aggregate form with advertisers so that they can target advertisements to special demographic groups or market segments.

 

Contact Information and Third Party Data. We use this information to respond to your inquiry, and to enable third-party advertisers to let us know that you have contacted them.

 

4. Who is collecting your information?

 

While you are on the Site or the related payment processing page we will be collecting information and the Host of the Site and/or PayPal or another payment processing company may collect information for us, unless it is specifically stated otherwise. In addition, some of our advertisers may track the links that you click on to visit their sites in order to confirm that your visit to their site originated from our site. Any visits to advertiser’s sites are subject to each advertiser’s privacy policy. If any company other than ours is collecting personal information (other than companies collecting information on our behalf), you will be notified prior to the time of collection or prior to the transfer of information to a third party by us. We may reference, recommend or provide links to third party Web sites. We are not responsible for the third party Web sites, recommended or not, and you should review the privacy policies posted on these sites. Please be aware that we do not control, nor are we responsible for, the privacy policies or information practices of third parties or their Web sites. If you do not want to have your personal identifying information shared with an advertising partner you can choose not to use the services offered by the advertising partner. You may also change your personal identifying information kept in our Profile on you at any time by sending us an email or dated letter that identifies your former identifying information and your new identifying information. 5. With whom do we share your information?

 

We will not disclose your personally identifiable information to any third party, except if you have given us your consent for such disclosure or if the disclosure is described below. We may share your non-personally identifiable information with third parties.

 

We may share your personally identifiable information with third parties that provide services on our behalf. Such third parties do not have the right to use your information for any purpose other than to provide the applicable service.

 

We may share your personally identifiable information with our affiliates that are subject to privacy policies that protect your personally identifiable information from disclosure to third parties in a manner similar to this Privacy Policy.

 

If we sell, assign or transfer our business or a part of our business that provides a particular service or merchandise to you, your personally identifiable information may be sold, assigned or transferred as a part of such transaction.

 

We may disclose your personally identifiable information, any communications sent or received by you, and any other information that we may have about your account as follows: as may be required by law, regulation, rule or court order; pursuant to requests from governmental agencies or law enforcement authorities; as necessary to identify, contact or bring legal action against someone who may be violating the Rules; to operate the Film or its related services properly; or to protect us, our members or other third parties including, without limitation, other emergency situations.

 

6. How may you update your Information?

 

The information you provide during registration for Contributions, purchases, advertising, or becoming an Executive Producer or Associate Producer, or during your use of the Site, is placed in a Personal Profile that is kept at our headquarters and/or legal department’s office. The only identifying information that will be posted online for public viewing is your name and region if you are a private Contributor; your name and business contact information if you are a business contributor, advertiser, or Executive or Associate Producer; and your web site link or URL if your business contribution or advertising agreement calls for links to your business web site. We do not maintain online Personal Profiles. You may update your Personal Profile information by sending an email or letter to us that identifies your former identifying information and your new identifying information, which is subject to verification. If your identity or your changed information cannot be verified, we will not change your Personal Profile. If you are waiting for merchandise or a thank you gift, we recommend that you notify the post office as well as our company of your forwarding address in order to help ensure proper delivery. We will not be responsible to track down and provide merchandise, thank you gifts, information, or announcements to individuals or business entities that have moved without providing both our company and the post office with a forwarding address.

 

7. How do we protect your personal information?

 

We and the companies acting on our behalf employ security systems to protect the information we receive from you. In addition, the information in your Personal Profile is maintained at our headquarters and/or legal department’s office. We attempt to confirm changes that are made to your Personal Profile by email or mail. We will also report suspicious or fraudulent activities to and cooperate with the appropriate legal or governmental authorities. Please be aware that Internet data transmission is not always 100% secure and we cannot warrant that information you transmit utilizing the Site is 100% secure. Because security is important to us and to you, we will always make reasonable efforts to ensure the security of our systems.

 

8. A note about the privacy of minor children.

 

We do not knowingly enter into contractual relationships with children under the age of majority. We therefore would only collect, use, and disclose personal identifying information about minor children if they have fraudulently misled us into believing that they are adults or if they have made a voluntary posting under the Guest Book section of the Site. However, the portions of this Privacy Policy that relate to the gathering of non-personally identifying information, such as cookies and details regarding the computer used to access our site, are applicable to children because we do not have an opportunity to determine the age of the person visiting the site in those circumstances. We believe that it’s especially important to protect children’s privacy online and encourage parents and guardians to spend time online with their children to participate and monitor their Internet activity. If you are under the age of majority, we recommend you get your parent’s permission before disclosing any information about yourself to anyone on the Internet, including in our Guest Book. We do not filter advertisements or other content that children may receive, and they could receive content and materials from the Internet and/or advertising that are inappropriate for children. We recommend that parents and guardians independently research and obtain appropriate parental control software.

 

9. A Special Notice to parents of children under 13.

 

In compliance with the Children’s Online Privacy Protection Act and fair information practices, we will not knowingly gather information regarding children under the age of 13 without parental consent. As part of the registration process for Contributions, purchases, advertising or becoming an Executive or Associate Producer, we collect personal and other information, but we require the Contributors to be over the age of majority. However, visitors who post information in our Guest Book have the information they submit there posted immediately without review or a pre-determination of the visitor’s age. We do not knowingly disclose children’s personal information to third parties.

We collect a variety of information on the Site including, without limitation, personal information such as first and last name, e-mail address, birthday, telephone number, credit card number, and non-personal demographic information such as gender, education level, occupation, income, interests and information relating to a various topics. Most of this information is collected through the profile our subscribers fill out when they contribute or when they respond to questions of The Tesla Conspiracy Movie, Inc., or its sponsors. We also passively collect data regarding the websites our subscribers visit and the functionality of our subscribers’ computers.

 

We use the information to uniquely identify each contributor, purchaser, advertiser, or Executive or Associate Producer and to research their demographics, interests and behavior. This enables us to design and improve our marketing and financing campaigns, to tailor advertising to specific demographic groups or market segments, to perform data analysis for marketing and computer research, and to perform administrative functions. We also use the information to respond to the duly authorized information requests of governmental authorities. We use information about computer functionality to allow us to deliver compatible technologies and services to the Site’s visitors.

 

We do not knowingly disclose the personal information of children to third parties.

 

The Children’s Online Privacy Protection Act prohibits all operators from conditioning a child’s participation in an Internet activity on the disclosure of more personal information than is reasonably necessary to participate in the activity.

 

The parent of a child who is under the age of majority and has fraudulently become a Contributor, purchaser, advertiser, or producer, or who has made a voluntary posting in our Guest Book can review and have deleted their child’s personal information and refuse to permit further collection or use of their child’s information by sending a verifiable email or letter regarding their child’s Personal Profile information. You may terminate your child’s listing in the Film’s online or on-screen credits at any time by submitting a verifiable request to us via email or letter to our legal department at moffice@ArtisticLawyer.com or 25129 The Old Road, Suite 114, Stevenson Ranch, CA  91381.

 

This Special Notice is effective as of August 27, 2005 and is not effective prior to such date. This Special Notice only relates to children under the age of 13 and is not applicable in any respect to children 13 or over. In the event we make any changes to any of the information set forth in this Notice, we will promptly revise this Notice accordingly and make it available in our Privacy Policy located at http://teslaconspiracy.com.

 

10. Use of Cookies.

 

The Host of the Site may use a feature of your Web browser called ‘cookies’ to automate certain aspects of our Site and Services. Cookies are very small files that are stored on your computer and that enable us to recognize your computer each time you return to our Site or use any of its related services. By using cookies, we can keep track of your preferences, what you have already seen on our Site and what you haven’t, and any personalization you’ve done, without requiring you to enter a password every time you come back. We use any information gathered using our cookies in compliance with this Privacy Policy.

 

Third parties, including advertisers with whom we may have a relationship, may also set cookies. Such third parties are responsible for placing and using such cookies and may collect information about you through such cookies; we do not have access to such cookies, control the use of such cookies nor control over the privacy policy of such parties.

 

We may use an e-mail delivery and marketing company to send e-mails that you have agreed to receive. Pixel tags and cookies are used in those e-mail messages and on the Site and its related services to help us measure the effectiveness of our advertising and how visitors use the Site and its related services.

 

11. Other information about your privacy while visiting and using the Site, contributing, or advertising.

 

We collect information regarding visitors’ interactions with the Site during their online sessions. We also collects information regarding Contributors, advertisers, purchasers, and Executive or Associate Producers. This includes information about which advertisements are displayed to a visitor, which advertisements a visitor clicked on, which buttons or other links in the Site a visitor clicked on and a visitor’s other interactions with the Site and its related services. We may also track visitors’ traffic patterns throughout their online session, including which Web sites a visitor links to or from while coming to or leaving the Site and which pages a subscriber views while using the Site. The Host of our Site and PayPal or other payment processing companies acting on our behalf may implement their own unique technology to build a database of the pages you visit and information you provide while you are using the related service or the Site. With the exception of specific identifying information that is collected and passed on to us as part of the processing of payments or Contributions, this information is ultimately stored in the form of categories, and, in some cases, specific URLs. We use your IP address to diagnose problems with the Site, its servers and software, and to administer the Site.

 

12. Privacy Policy Changes

 

If we change any of our privacy policies, the changes will be posted in this document so that you will always know what information we gather, how we might use that information and to whom we will disclose it.
